Molteforme Commercial Warranty Terms

Please read these Warranty Terms carefully and use the Product in accordance with its intended purpose and the Installation and Maintenance Manual supplied with the Product. Proper installation, use, maintenance and cleaning are essential to ensure reliable and long-term performance of the Product.

General Provisions

FINITURA sp. z o.o., with its registered office at ul. Stanisława Taczaka 24/103, 61-819 Poznań, Poland (hereinafter referred to as the “Guarantor” or “MOLTEFORME”), provides this commercial warranty for MOLTEFORME Products purchased by Consumers within the European Union from MOLTEFORME or an authorised seller.

For the purposes of this warranty, a “Consumer” means a natural person purchasing the Product for purposes outside their trade, business, craft or profession.

This commercial warranty is provided in addition to the Consumer’s statutory rights. In the event of a lack of conformity of the Product, the Consumer is entitled to remedies against the seller free of charge in accordance with applicable law. These statutory rights are not limited, replaced or otherwise affected by this commercial warranty.

Warranty Declaration

The Guarantor warrants that MOLTEFORME Products are free from defects in materials and workmanship, provided that they are installed, used, maintained and cleaned in accordance with their intended purpose and with the instructions set out in the Installation and Maintenance Manual supplied with the Product or made available on the MOLTEFORME website.

The commercial warranty covers defects in materials or workmanship that existed in the Product at the time of delivery to the Consumer and become apparent during the warranty period.

The Consumer should verify the completeness and visible condition of the Product upon receipt and before installation. Any visible damage, missing components or other apparent irregularities should be reported before installation whenever reasonably possible.

The Product should be installed in a manner that allows reasonable access and removal without unnecessary damage to surrounding fixtures, finishes or building elements.

Unless mandatory applicable consumer law provides otherwise, this commercial warranty does not cover costs related to gaining access to the Product, including removal or replacement of tiles, wall coverings, furniture, housings or other surrounding elements.

Where access to the Product is required in order to perform warranty service, the Consumer may be asked to provide such access before the warranty service is carried out.

Minor differences in colour, surface appearance, dimensions or finish resulting from the manufacturing process and remaining within normal manufacturing tolerances do not constitute a defect, provided that they do not materially affect the functionality, durability or intended use of the Product.

MOLTEFORME Products Warranty Coverage

Bathroom accessories: 2 years.

The warranty period begins on the date of purchase indicated on the purchase document or other reliable proof of purchase.

This commercial warranty applies to Products purchased on or after the effective date of these Warranty Terms.

Claim Submission

Before submitting a warranty claim, the Consumer should check whether the issue may have resulted from improper installation, use, cleaning, maintenance, transport or storage.

Warranty claims may be submitted through the MOLTEFORME website:

or directly to the seller from whom the Product was purchased.

The Consumer is requested to report the defect without undue delay after discovering it.

The warranty claim should include:

1. The Consumer’s contact details;
2. The place where the Product is installed, if applicable;
3. The Product name or model, where available;
4. A detailed description of the defect and the circumstances in which it occurred;
5. Photographs or other documentation where reasonably necessary to assess the claim;
6. Proof of purchase, such as a receipt, invoice or other reliable evidence of the date and place of purchase.

Unless expressly requested by MOLTEFORME or agreed with the seller, the defective Product should not be returned before the claim has been reviewed.

Warranty Services

MOLTEFORME will respond to a warranty claim within 14 calendar days after receiving the information reasonably necessary to assess the claim.

If the claim is accepted under this commercial warranty, the Guarantor may, depending on the nature of the defect and the circumstances of the case:

1. Repair the defective Product;
2. Replace the Product with a new, defect-free Product; or
3. Authorise the seller to refund the purchase price.

These remedies apply to this commercial warranty and do not limit any statutory remedies available to the Consumer under applicable consumer law.

If repair is selected, MOLTEFORME reserves the right to determine whether the repair will be carried out at the place of installation or at another suitable location.

Repairs and replacements under an accepted warranty claim will be carried out without undue delay and within a reasonable period, taking into account the nature of the Product, the type of defect, the place of installation and the availability of replacement products or components.

MOLTEFORME covers reasonable repair and shipping costs directly related to an accepted warranty claim.

The Consumer must make the Product available for inspection where this is reasonably necessary to assess or perform the warranty service.

If the Product needs to be sent to MOLTEFORME or another designated service location, the shipping procedure will be agreed with the Consumer. The Consumer must package the Product appropriately to prevent damage during transport.

A defect or damage caused by improper installation is not covered by this commercial warranty.

Where additional dismantling, access or installation work is required because the Product was installed contrary to the Installation and Maintenance Manual, such additional costs may be charged to the Consumer, provided that the Consumer is informed of those costs in advance and agrees to them before the work begins.

Warranty Conditions and Exclusions

This commercial warranty does not cover defects or damage resulting from:

1. Normal wear and tear that is not caused by a defect in materials or workmanship.
2. Replaceable toilet brush heads and other consumable components subject to normal wear.
3. Sediment, limescale, impurities or contamination in the water supply.
4. Mechanical damage, including scratches, dents, impacts or deformation caused after delivery by the Consumer or third parties.
5. Improper cleaning or maintenance, including the use of abrasive sponges, abrasive cleaners, solvents, acids, vinegar or other unsuitable cleaning products.
6. Use of the Product contrary to its intended purpose or contrary to the Installation and Maintenance Manual.
7. Incorrect installation or the use of tools, adhesives, mounting materials or installation methods contrary to the instructions provided for the Product.
8. Repairs, modifications or alterations performed without authorisation where such work caused or contributed to the defect or damage.
9. The use of non-original parts or components where their use caused or contributed to the defect or damage.
10. Improper transport, handling or storage after delivery where such activities were carried out by the Consumer or by third parties not acting on behalf of the seller or MOLTEFORME.
11. Failure to adequately protect the Product during construction, renovation or finishing works.
12. Minor cosmetic variations or irregularities that do not materially affect the functionality, durability, safety or intended use of the Product.
13. Minor dimensional, colour or surface variations resulting from the manufacturing process and remaining within normal manufacturing tolerances.
14. Exposure to temperatures or environmental conditions for which the Product was not designed, including sub-zero temperatures or outdoor installation where the Product is intended exclusively for indoor use.
15. Accidents, misuse, extraordinary external events, natural disasters or other events beyond the reasonable control of the Guarantor.
16. In the case of discounted, exhibition or incomplete Products, the warranty does not cover a specific defect, damage, missing component or other irregularity that was clearly disclosed to the Consumer before purchase and expressly accepted by the Consumer.

The exclusions above apply only to the extent permitted by applicable law and do not exclude or limit the Consumer’s mandatory statutory rights.

Final Provisions

This commercial warranty is valid within the European Union.
